EPM, a responder a las familias desplazadas por Hidroituango

El Consejo de Estado estableció que Empresas Públicas de Medellín (EPM) sí debe ser reconocida como la llamada a responder patrimonialmente por los eventuales perjuicios que genere la construcción y posterior operación de la Hidroeléctrica de Ituango.

10 de agosto de 2021.   El Consejo de Estado le ordenó al Tribunal Administrativo de Antioquia reconocer a EPM como la llamada en garantía de un proceso de reparación colectiva que cursa en contra Hidroituango.

La decisión obedece a una solicitud que presentó la hidroeléctrica, con el fin de que EPM se viera obligada a responder con su propio patrimonio frente a las eventuales acciones judiciales que se produjeran con ocasión de la construcción y posterior operación del proyecto de energía eléctrica.

Lo anterior, teniendo en cuenta la demanda de acción de grupo que instauraron habitantes de municipios aledaños al río Cauca, que se vieron avocados a evacuar sus viviendas ante la inminencia de inundaciones, derrumbes, avalanchas y otros potenciales desastres originados por la inundación del túnel de desviación de la hidroeléctrica de Ituango.

La solicitud fue conocida por el Tribunal Administrativo de Antioquia, que es el operador jurídico que está a cargo de esta demanda, que persigue la indemnización de perjuicios a las familias que abandonaron sus viviendas por la crítica situación que se registró en diciembre de 2018, cuando las inundaciones registradas en la compresa estuvieron a punto de provocar el desbordamiento del río Cauca.

El Tribunal negó la vinculación de EPM como llamado en garantía, por considerar que Hidroituango no demostró la existencia de la compañía. “Ello, debido a que con la demanda de llamamiento solo se aportó la prueba de la representación legal de EPM, pero no los documentos que acreditaban su existencia”.

La decisión fue apelada por Hidroituango, que aspiraba a que el Consejo de Estado reconociera a EPM como llamado en garantía dentro de esta demanda de acción de grupo.

La alta corte accedió a las pretensiones y sostuvo que Hidroituango allegó copia de los documentos que acreditaban la representación legal de la empresa industrial y comercial del Estado llamada en garantía, la cual se radicaba en cabeza de su gerente general.

Tal circunstancia era suficiente para que el tribunal de primera instancia, en aplicación de lo dispuesto en el artículo 177 del Código General del proceso (CGP), accediera a la información pública disponible en el sitio web de la empresa, en donde se encuentran los documentos contentivos del acto de su creación, señaló el alto tribunal en un comunicado.
